Terms of stay

Welcome to Pumphouse Point

It is important to us that you get the most out of your stay, and in order to do that you’ll need to understand our Terms of Stay. These are important because they: 

  • Explain your obligations during your stay including rights we need you to grant us; and 

  • Explain how to keep yourself safe and what happens if things go wrong. 

By making a booking to stay at Pumphouse Point (either directly with us or through our website), you accept these Terms of Stay on behalf of yourself and all other persons staying at the property under your booking. If you made a booking with us via a telephone channel and were not provided with these Terms of Stay at the time of booking and you are not satisfied and do not wish to accept these Terms of Stay, you may cancel your booking and receive a full refund within 48 hours of being provided your booking confirmation email. Please read these Terms of Stay carefully. Some terms used have a specific meaning given to them in the ‘Definitions’ section below. Our agreement with you includes these Terms of Stay, the Booking Conditions (), and our Privacy Policy ( ). You need to read all of these together and if there is any inconsistency between them, these Terms of Stay prevail. 

Important Information 

 

Risk: 

Your participation in activities or facilities at the property is at your own risk. Parents and guardians are responsible for persons under their supervision and must evaluate any risks on their behalf. 

Our limited 
liability: 

To the extent permitted by law, we will not be responsible or liable for any loss, damage or injury however caused nor any consequential loss or damage, arising from your visit to the property, and you assume all risk associated with your visit to the property unless that loss, damage or injury is caused by our negligence or misconduct. 

Additional 
costs: 

You may be liable for extra cleaning costs if you fail to comply with our no-smoking policy or leave the accommodation excessively dirty. You may also be liable for items missing from your accommodation or damage to our property caused by you (or those staying with you). 

Consequences 
of material 
breach: 

If you commit a material breach of this agreement, we may require you to leave the property, evict your party from the property or suspend or prohibit access to our Services and/or the property. 

  Your responsibilities during your stay During your stay at the property, we want you to relax and enjoy but you must also:  

  • take care for your own safety and the safety of others by obeying all rules, guidelines and signage in and around the property and all reasonable requests of people managing the property (view more about Keeping Safe below); 

  • check-out by 10am, unless alternative arrangements have been agreed with us prior to arrival; 

  • return all keys to reception on check-out; 

  • abide by the signed speed restrictions shown in the property; 

  • securely lock your accommodation including personal and recreational equipment when unoccupied; and 

  • ensure that all other persons who stay with us under your booking at the property comply with these obligations also. 

Some other things you should know: 

  • Pets: Unfortunately, the property is not pet friendly, and no pets will be allowed to enter. 

  • Assistance animals: Assistance Animals are welcome at our property. If you intend to be accompanied by an Assistance Animal, please let us know at the time of booking or prior to your arrival (view our 

  • Accessibility: Please let us know at the time of making your booking or prior to your arrival if you have any accessibility requirements. 

  • Additional guests: If additional guests exceeding those contemplated in your booking wish to stay with you, further charges may apply and accommodation may need to be booked by you or those additional guests.  

  • No smoking: During your stay at the property, you must not smoke in accommodation, in/around internal communal areas or in areas prohibited by law. If you don’t comply with our no-smoking policy you will be charged a fee of up to $250 to cover our reasonable extra cleaning costs and/or to compensate us for our inability to rebook your accommodation after you have left. This amount will be charged to your credit card (following reasonable notice to you) or deducted from your cash bond upon check out.  

  • When you leave: If you leave the accommodation excessively dirty, if any items are missing from the accommodation or if you (or those staying with you) damage our property, an amount to cover our reasonable costs to return the accommodation to its prior state will be charged to your credit card (following reasonable notice to you) upon check out. 

  • Other: Unless you have made a genuine group booking, our accommodation is provided to you for your own use and must not be sublet or resold by you for commercial gain without our consent. By staying with us, you also confirm that you are a guest staying at the property for holiday purposes. 

Some rights you grant us 

So that we can keep the property safe and maintain our high standards, you consent to us:  

  • using surveillance cameras that may record your activities in public areas of the property; and 

  • photographing you for the purposes of internal record keeping, advertising and marketing, but you may withdraw this consent by telling our photographer at the time that you do not wish for your photo to be taken. 

A few limitations on your use of our services We built our business on the idea of helping people and we hope that you will help us continue that tradition. To that end, we ask that you use our services in good faith and in a way so as to not bring disrepute or cause reputational or other damage to us or our NRMA Parks and Resorts and you agree not to engage in any of the following prohibited behaviour.  You must not use our services in any way that is defamatory, fraudulent, unlawful, threatening, intimidating, harassing, disrespectful, inappropriate, harmful, hateful, abusive, tortious, obscene, invasive of another’s privacy, sexist, racist, homophobic, violent or degrading.  What may happen if you breach this agreement We reserve the right to take any of the following actions if you commit a material breach of this agreement:  

  • issue you with a formal warning; 

  • require you to leave the property or evict your party from the property; and/or 

  • suspend or prohibit access to our services and/or the property. 

Keeping Safe 
We offer an array of activities and experiences for you to enjoy at Pumphouse Point and we take great care to ensure your safety. However, you need to be aware that engaging in some of the activities we offer and using our facilities comes with risks which may potentially result in personal injury, death, property damage or economic loss. By participating in these activities or using our facilities, you do so at your own risk (although, if something goes wrong, you may have some rights and remedies available to you under the Australian Consumer Law which we cannot exclude or modify). To keep yourself safe, you should: 

  • act in a responsible manner while using our facilities; 

  • refrain from any behaviour which could affect your safety or the safety of others; 

  • take care to observe and follow all signage and any instructions around the property; 

  • make sure you follow any conditions of stay specific to the property you are staying at; 

  • follow all reasonable instructions given by personnel managing the property; and 

  • prior to undertaking any activity or using any facility at the property, be satisfied that you are aware of all the risks involved, including risks associated with pre-existing health conditions, and consider your participation using good judgement. 

In the event of any illness or injury to you, you consent to the property administering and obtaining any medical treatment which the property considers necessary in the circumstances.  

 Our liability to you The Australian Consumer Law provides certain statutory guarantees for consumers which cannot be excluded, for example that services will be provided with due care and skill. Nothing in these Conditions modifies, excludes or restricts those guarantees or the remedies that may be available to you if we breach them. To the extent permitted by law, we will not be responsible or liable for any loss, damage or injury however caused nor any consequential loss or damage, arising from your visit to the property, and you assume all risk associated with your visit to the property unless that loss, damage or injury is caused by our negligence or misconduct. You are otherwise responsible for making your own inquiries before deciding whether to engage in any activity whilst at the property.  Events beyond our control If we are unable to provide our Services to you due to causes beyond our control (such as flooding, earthquake fire or pandemics), we will not be in breach of this agreement but will refund or offer you a credit for monies paid by you under this agreement for anything we can no longer supply.   

Governing law 
This agreement will be governed by the laws of the state or territory in which the property is located. The parties agree to submit to the non-exclusive jurisdiction of the courts of that state or territory and of the Commonwealth of Australia.   General If we do not enforce a provision in this agreement, it will not be considered a waiver.  You may not transfer any of your rights or obligations under this agreement without our consent.   

Definitions In these Terms of Stay Conditions: 

  • “this agreement” means our agreement with you comprising these Conditions, the Booking Conditions, the Privacy Policy and any applicable Conditions of Stay; 

  • “Booking Conditions” means the booking conditions for Pumphouse Point which can be located on our website Booking conditions

  • “Terms of Stay” means these terms and conditions; 

  • “NRMA Parks and Resorts” means the properties owned, operated or managed by us as listed on our website nrmaparksandresorts.com.au; 

  • “our services” means the provision of accommodation and related services that we provide to you under this agreement; 

  • “Property” means Pumphouse Point; 

  • “Privacy policy” means the privacy policy for NRMA Parks and Resorts which can be located on our website Privacy policy

  • “we”, “our” or “us” means Australian Tourist Park Management Pty Limited ACN 061 270 513 which is a wholly owned subsidiary within the group of companies owned by National Roads & Motorists Association Limited (ACN 000 010 506); and 

  • “You” and “your” means the person making the booking and any person in the party you are booking for or who you or they are responsible for while using our Services.
